Gov. Togiola bans children’s toys with lead-based paint from China
(UTULEI) – Governor Togiola Tulafono today issued an executive order to ban the importation and sale of all toys from China that has been listed by US Consumer Product Safety Commission.
EXECUTIVE ORDER NO.: 006-2008
AN ORDER BANNING THE IMPORTATION AND SALE OF ALL TOYS AND PRODUCTS CONTAINING EXCESSIVE LEVELS OF LEAD FROM CHINA AS LISTED BY THE UNITED STATES CONSUMER PRODUCT SAFETY COMMISSION.
Preamble
The U.S. Consumer Product Safety Commission (CPSC) is an independent agency charged with protecting the public from unreasonable risks of serious injury or death from thousands of types of consumer products. The CPSC has issued a number of recall notices concerning the use of lead based paint being used in children’s toys and other products. It has been well documented that lead mat cause irreversible neurological damage as well as kidney disease, cardiovascular effects, and reproductive problems.
Section 1. Authority
This Executive Order is issued under the authority granted to the Governor in Article IV, Section 6 and Section 7, American Samoa Revised Constitution and ASCA Section 4.0111.
Section 2. Order
In order to protect the public health, safety and welfare against toys and other products containing lead based paint from being imported into and sold within the Territory, all products from China listed by the United States Consumer Protection Safety Commission (CPSC) as being recalled for lead contamination are herewith banned. These products include all those listed in "Appendix A" and any others, which may be added from time to time.
Appendix A is not an exhaustive list, it only highlights those toys and products which have been added by CPSC over the past year and are the recalled items most likely to be on store shelves and/or to be imported into the Territory. It is important for consumers and agencies to visit the CPSC website to determine if any of the products they already own may have been recalled. http://www.cPsc.gov/cgi-bin/cmfg.aspx
ASG Customs Division of the Department of Treasury shall ensure that all products listed herein, and any others that shall be listed from time to time by the United States Consumer Product Safety Commission (CPSC) shall be held at the wharf and shall not enter into the Territory for any type of use, sale or consumption for any reason.
Section 3: Interagency support
All ASG agencies, including but not limited to the Department of Treasury, Department of Health, the Department of Commerce, the Department of Port Administration, and the Office of the Attorney General shall facilitate and coordinate efforts to effectuate this ban.
All such agencies that shall provide support pursuant to this Section shall meet at least once each month beginning December 2008. This interagency committee shall be headed by the Directors of Health and Commerce. The committee shall provide a report on the status of the ban ordered herein and shall set forth recommendations for any further actions necessary to protect the public health, safety and welfare of the Territory.
Section 4. Effective Date
This order shall take effect immediately.
